Most current smoking bans have been framed as a matter of safe working conditions; they are to protect the wait staff, as opposed to the restaurant patrons. So are you also opposed to other workplace safety laws? After all, if employment is a contract between employer and employee, which the employee is free to reject if the situation does not meet his requirements, then there is no reason to force employers to maintain safe working conditions. Employees should be allowed to work at the Triangle Shirtwaist Company whether it has fire exits or not. Right? Nobody is making them work there. They could work in a safer place--if there is a safer place.

In the particular case of bars, if most or all bars allow smoking, then a bartender can't really choose whether to work in a smoky environment or not.

me too! but even if they are they are probably still paying to educate someone elses kid through school tax. further proof of the inequity of the system.
