I'm not surprised that Thomas and Scalia are statists at the end of the day. I haven't noticed them standing up for much in the way of the rights of individuals against bigger powers. But I'm surprised Kennedy signed on to such nonsense. Are you expected to live at a property just because you own it? I wouldn't think so.
