Here's our story, we purchased a china cabinet from Levitz in September of 2005, they told us it would be delivered in October. Since then we've received letters stating delivery is delayed and claimed a refund was available. We were screwed from the start because we had already purchased and received the dining set to match, getting our $$ back would only mean we wouldn't have a complete set. The last letter we got said it would get here on Feb. 20th. We found out a couple weeks ago that Levitz went bankrupt, we were never notified, we only found out because we called to check on the delivery. At this point we want our $$ back but the company that took over will not give us a refund. Today I called to check and the delivery has been pushed back to May! Their customer service told me to file a claim with the US bankruptcy courts. What pisses me off even more is that if you go into any of their remaining stores they will sell you stuff as if nothing is wrong, they won't tell you there's a good chance that you'll never get your stuff, they'll give you a fake delivery date and let you deal with it later. short of getting myself arrested there's nothing I can do. I spoke with the NY office (bankruptcy court) and they told me how to file a claim however advised that because I am considered an unsecured creditor the amount of $$ I get back will most likely be nominal. F*@k!! Do not buy from them!!!!!!!!!!!!! I E-mailed all those news stations that do the "on you side" type stories, and I'm printing up full page flyers outlying the type of BS they do. On my day off I'm gonna stand outside the store and pass them out to people going in & put them on the windows of cars in the lot.

Why cant you just dispute the charge with your credit card company? They charged you for merchandise that was never delivered... I think most cards will side with you relatively quickly. |

Cmonty - Why cant you just dispute the charge with your credit card company? They charged you for merchandise that was never delivered... I think most cards will side with you relatively quickly. Of course this is one of the few purchases we made in cash so much for trying to cut down on using credit |

Almost the same thing happened to us....delay after delay after delay and so we cancelled and got a credit on our credit card, but that was before (Nov I think) they declared bankruptcy. It's infuriating and unethical for a company to knowingly take orders that they cannot possibly fill. We were lucky I guess. |

SO Sully, the same thing happened to us when we ordered a bedroom set from Huffman Koos. They had a huge 4th of July promotion sale & gave an additional discount for cash deposits. About a week later, we read in the paper that HK had declared Chapter 11. After numerous calls to the Livingston store where we had made our purchase, we were told that it was unlikely that any orders made after a certain date (like ours)would be shipped out. We were told we could take the floor model pieces, which were damaged,and pay the full remaining balance on our order. This was, of course, entirely unsatisfactory, but my husband was able to go to the store & pick out floor samples of some small items to use up the credit from from our initial cash deposit. It really burned me up that they had done such extensive advertising for this big sale when they probably knew that a bankruptcy filing was in the works. I've sworn from now on to only purchase furniture from major (ie. Macy's, Bloomingdale's etc.) outlets. Mrs. George |

I always purchase my furniture from North Carolina outlets. Name brands and prices are much cheaper. www.rosefurniture.com www.furniturelandsouth.com
