judge judy would have found brett in the wrong. she did something stupid but throwing a banana at her is assault and you cannot do that. it was not self defense. it was assault. period.

brett, at 6am with noone around, wouldn't a loud "hey ***hole" get her attention just as well and really show what you felt about her?

No she deserved a swat with a banana. And really people, I didn't knock her down and beat her with it, I just tossed it at her.

"If the roles had been reversed and you had blocked someone in their parking space for a time, would you have considered that person justified in hitting you in the head with a flung banana?" Yes, I would deserve to be humiliated.

Brett- I understand your anger with this self-involved witch, but two things to ponder:

1) Legally, it IS Simple Assault (there is no battery in N.J.).

2) Your sparring party undoubtedly shared her experience with her friends and family, only with her own personal spin on it, and they are likely to encourage her to take action against you. If she has your license plate number, it will be easy for her. And if anyone tips her off regarding this thread on MOL, you will have handed her a most compelling bit of evidence for both a criminal complaint and a civil lawsuit against you.

Hopefully none of this will come to pass, but I'd refrain from such "frontier justice" in the future.

I'm sorry. I read all these posts and I just keep coming back to one thing: Yes, Brett did commit a "crime" and put himself at risk in this litigious day and age. I can hear Judge Judy yelling "that doesn't give you the right to do the wrong thing and act like an idiot." But I almost pissed myself laughing. And I love the reenactment.

Brett, its a good thing you picked the banana up, otherwise SLK would have been at your front door to harass you about littering.

Really what you did was totally wrong. The woman ignored you and you threw your fruit? Not just wrong but stupid. You should have moved your feet, followed her until you caught her and then confronted her verbally when she acknowledged you.

If that had been my spouse you hit - not saying it ever would be but, she would have beat your .

I think you are one lucky sob and I would be apologetic for having a temper that got carried away over a very minor incident.

Greenetree hit the salient point - in today's "sue sue sue" environment, I would not have been surprised had the woman fallen down, grabbed her neck and screamed, "Oh my god the agony... get me a lawyer - I mean, doctor. Get me a doctor!".

Having said that, I applaud Brett for 'calling bulllshit' on someone who is THAT self-posessed. We see this behavior all the time, in stores, on the road - I don't know what is going to end it, but something HAS to give sooner or later.

Personally, I'm hoping that a critical mass of people reach the same point at roughly the same time. A few assbeatings for violating simple common courtesy might just stem the tide of rudeness!

My only concern is that Brett gets jammed up. This inconsiderate azzhole deserves something but the law is on her side. It's great to see such a person get called on their zhitty behaviour, but not at the cost of Brett losing in the long run.

Ok people, on the 4th I will be on the bunny’s side of Floods Hill 50 feet from the top of the hill. You will notice me by the stack of bananas that I will use on the corners of my blanket to hold it down. If you honestly think that I have done wrong, by bouncing a banana off a woman’s head. Please come by for a demo. Bridezilla will stand 10 feet from me I and I will throw bananas at her head. YES you heard me right, I will assault my soon to be wife with fruit, to show you that it’s really not that bad.

I will then turn the tides and allow you to throw a banana at me (I will sign any waver you think necessary) to show that I don’t fear fruit!!!

Loosen up. That lady did something wrong, she was lazy and inconsiderate. I tossed a banana at her and HUMILATED her into realizing what she had done.

Brett, My Love, I did a little research after thinking about this thread and am afraid that I can no longer support you. I did not realize just how serious this matter is. The following are just a few examples from my research.

Posted 3/9/2004 2:00 PM USA Today Updated 3/9/2004 8:07 PM
What's your phobia?

"I'm a little embarassed to admit this. My husband constantly harrasses me because of it, but I have an overwhelming fear of bananas. It's not just a case of not liking the taste. I'm terrified of them. They have to be in a certain place in the kitchen. If I find them anywhere else, I freak. I'm not really sure what it is. I hate the smell. I hate the feel of the peel. In my mind, they're evil." —Allison Jones, Hanover, Pa.

Bananaphobia Fear of bananas.

From tv.com posted 4/29/06

Well, let's start off with the fact that every time one of my friends or I bring a banana to school in our lunch, it is 100% required that we through it away unless we want a bad reputation forever. Here's Why:

My friend, let's call her Jane, had to go to this class one summer to learn about a specific interaction that would probably get me in trouble if I spoke of it in here. On one occasion, they forced all of the students in the class to put a special object around a banana (which resembles another special object/body part). By eating a banana at lunch, nowadays, you are going to be thought of as eating that "special object".

Yes we are quite ********* aren't we?

Well there's my life story!

*****************************************

And on it goes. I never realized what a cruel, cruel man you are.

relax, most of us aren't all that PC. I don't care if you tossed a banana at a self-centered jerk, but color me unimpressed that you threw something at someone whose back was turned. I'd be more impressed if you caught up to the person and confronted her face to face and told her she was being rude and you expected her to move the car. and let's face it, to an extent you let her off easier by chucking someting at her. now she thinks you're also a rude jerk, and it probably makes her feel some justification for inconveniencing you. a firm polite, eye-to-eye "please move your car" would have likely made her feel more guilty.

Brett-

Hang in there among these PC whiners. I got the same treatment for confronting a litterer. They like to talk the talk but can't seem to walk the walk.

Tossing a piece of fruit at an a-hole, the horror....

Still no criticism of the woman parking illegaly?

Now Hoops wife is an kicker....I think I am going to test this claim.

Hoops, when/where does your wife grocery shop and what fruit does she absolutely despise?

Case,

Road rage comes to mind. It happens only rarely, I know, but when it does, it is tragic. I remember reading about one mother with children shooting another mother with children over some matter of incivility. It seems to me when you have to confront rude people in the matter that Brett did, the game is over and we are destined to live like slobs.

Anyway, I might do something like Brett did under some circumstances, but I wouldn't publish on MOL.

One of my favorite "rude-parking-lot-parental-teaching-repercussion-moments" stories was told to me by my pseudassistant.

Last year, she was at Walmart with her kids (7 and 9). As they got out of the car, a woman was getting into a car with her young kids in the next space over. My cow-orker had watched the woman load the kids, unload the cart and leave the cart between the cars.

This bothered my cow-orker. She likes to teach her children that we all need to do our part, including things like not being too lazy to walk 20 feet to the cart corral. So, she says to the woman "What the f*&^ is wrong with you? Do you think you can put the f*&^ing cart back, you lazy piece of s(*&?"

I died laughing when she indignantly told me this story on Monday morning. But, probably not for the reason that she thinks.

SLK,

How did you confront the litterer. Did you walk up to them and ask them to pick up the trash they dropped? Or did you throw the trash at them? The first way is the only way. I heard a true story of somebody who would pick up a litterers trash and go to them and tell them that they dropped this by accident, even if he had to follow them for some distance.

No matter how you cut it, Brett's approach was the wrong approach. And his assertions to the contrary not withstanding, I don't think he would have reacted in the same way had four young bucks stepped out of the car.

Brett,

Why not? Because I would have been embarassed at the way I reacted and would not seek to publicize it. OTOH, if I had caught up to the lady and told her to her face that she was blocking me and did she mind if I dented her car as I backed out, that would have been different.

Positive re-enforcement trains dogs and people.

I've spent years trying to get the cars to slow down at the crosswalk in front of Jefferson school.

I used to shake my fist (really) and get all uppity and pissed and worked up.

The past few years I've taken to stepping out in the cross-walk, holding out my open hand to stop traffic, then I wave and say "thank you" - when we're all safely across I wave again and thank again.

About 6 months into stopping with my hand and thanking, I noticed that I don't have to stop so much with the hand, people stop automatically at the cross-walk. It's the same people driving, and the same kids walking, the only thing that changed is making it friendly on one side - which spread to the other side.

My years of indignation didn't make a diff, but treating inconsiderate drivers with respect did.

I was getting on a train at Penn Station one night, and the door to the staircase wasn't propped open, so each person in the line had to hold the door open for the person behind them. I had something in my hand, so I tried to keep the door open for the next guy by putting my forearm against it, which he apparently didn't see. The guy absolutely went off on me, yelling and calling me an a****** for not holding the door for him (even though I did). this was several years ago, but I still remember that guy acting like a maniac. and if he had politely suggested to me that I hold the door for the people behind me, he'd have given me the opportunity to say that I was sorry if he didn't realize it, but I did try to hold the door for him.

If someone on the street hit me with anything...I'd lay them out, or at least attempt to defend and/or retaliate to the best of my ability. Winston you must agree with me when I say that even if he WAS Bruce Lee, that's no reason to go out and seek fights.

maybe the woman just found out she had cancer or her child is sick. maybe she had a real emergency. maybe she was emotionally distraught over something. i think sometimes it's best to assume someone has a reason for doing what they are doing and then have a little patience with them.
the other day i had just picked up two kittens from the JAC and was excited and nervous. As i made the right turn from Walton Road onto 3rd street, the car on 3rd street yelled at me "why didn't you put your blicker on, so & so?!!"
i couldn't explain to them that usually i do, and that usually i realize that is a bad intersection. i felt bad, but i had been distracted. (i didn't do anything terribly illegal, i just made it harder for them to get onto Walton road).

Lydia, you probably would have had better results with a stack of bananas. Throwing bananas is good exercise. It also relieves tension when you hit the target.
