The last storm uprooted a big, old tree planted between the sidewalk and the street gutter. The town has cleaned up most of the tree (though a huge trunk with roots is lying sideways still) but 3-4 concrete sidewalk "squares" were destroyed. Should town fix that? Any guess on the cost if I have to fix it and whether a normal homeowners insurance coverage would cover it (assuming the cost is more than my deductible)? Thanks. |

Unfortunately I believe it is your responsibility. I've heard that budgeting about $100/square is about right. |

But why not call the town and alert them to the problem and ask them to get it repaired first? |

The same thing happened to us a couple of years ago, in SO. Because it was a town tree, on the strip between the sidewalk and the street, the town paid for everything. |

An Update - The town administrator came by yesterday to inspect the site. He said we could file a claim at his office. He would then pass it along to the town's insurance company who would decide our fate. I'm not sure the criteria they use to determine whether they pay or not. |

I would hold your ground. I had three sections of sidewalk replaced at the towns expense two months ago. they were damaged from roots of trees on the strip between the sidewalk and the street |

I wonder if calling yur insurance company will help? If they know that you have reported the condition to the town, perhaps they will get involved. They don't want to be in the middle of a claim if someone trips over it. They may also be more effective at negotiating with the town insurance company, since they don't want to have to pay for anything. |
