While trying to park to go to the bank, I had the frustrating displeasure to be yelled at, cursed at, and physically intimidated by a guy working on a store on Prospect simply for asking if I could park in front of the store. I have had enough of this type of behavior, but rather than get into an argument with the hooligan I want to do something "legal" about it. Is there an ordinance in town about cursing and insulting people so that I can call the police and have them issue a report on this guy? This happened 15mn. ago and I'd like to go today, so if anyone can help quickly that'd be great. Otherwise, that's fine too - I can use the advise for future incidents. |

I don't think I have ever heard of such a law. Good luck. If you want, I will go back there with you, and the two of us can intimidate him. |

Lewd behavior ordinance perhaps? Thanks Mr. Mayor, but for now my whole point is to have a "legal" and "well behaved" route. So I'll try that first. If that doesn't work though... |

JazzMe, its a good idea to have ordinances against public abuse. No one should be subjected to it, not you and also not anyone with the misfortune to overhear it. |

Yes SOrising, it would be worth pursuing - Actually, I almost got relieved when I read one of the Town's ordinance, only to find out it only applies to the town's parks (?!?!) - does that mean I can curse, use abusive language, and threaten people in the middle of town without risking anything!? ----- ARTICLE I General Provisions [Adopted 12-3-1974 by Ord. No. 1438 as Section 3-10 of the 1974 Revised General Ordinances] § 193-1. Unlawful acts. It shall be unlawful for any person: [...] I. To utter any profane, threatening or abusive language or loud outcry or to perform any obscene or indecent act, or to commit any nuisance or to solicit any contribution or subscription, or to play any game of chance in any park or parkway of the Township or to bring into the park or parkway any instrument of chance or gambling whatsoever. ------ Oh by the way, if anybody was wondering, I called the police and - of course - they don't want to do anything.

"IF" it's a peaceable solution you want, I would park my car in front of the store anyway, and by-pass the jerk and speak directly to the owner of the property about the type of people he has working for him. I'd then report the employee who was cursing and insulting you to his boss. If the guy happens to be the boss, I would report him and his company to the Chamber of Commerce and the BBB... If this doesn't get the result you want, then step it up a little. Make up a poster, get a few friends together, and picket both the business and the contractor. If that still doesn’t work, then go to the United Nations Security Council, or call the Mayor and tell him to bring his bat...

Why did you feel you had to ask permission to park on a public street? I assume that the place you wanted to park was a legal parking space.

I asked a policeman about this once while in downtown Maplewood, and he said there was no ordinance against loud public swearing. Which meant, that he couldn't write a ticket or similar for a person doing that. He did say that if a citizen complained about such speach, he could. Not sure I understand the difference, legally, but it sounds like offensive speach is in the ear of the beholder. There were a lot of little kids around on this occasion, and some teenagers were revelling in loudly swearing, etc. I can see where it's a tricky topic, but I do wish that if manners failed people, or sense of public decorum, there was some grounds for disciplining/punishing. |

If he was cursing and swearing at you, then he was threatening violence. That is a credible complaint, no? I'm with Bob, tho. If it was a legal spot, why did you need his permission? |

JazzMe: We do have an ordinance prohibiting this kind of behavior, and it is not limited to public parks. On March 21, 2006, the township committee passed Ord. no. 2341-06, which, among other things, makes it unlawful for any person "To indulge in and utter loud, offensive, indecent or profane language in any public place with the intent to disturb other persons." If the police informed you or any other person that this behavior was not unlawful, please provide the particulars to me or any other person on the township committee. This ordinance was specifically requested by the Police Department. |

Would this also apply to delivery trucks that are parked illegally, idling for 20 minutes or more, and when you ask them to move they verbally abuse you? If so, visit Inwood Place any day of the week.
