If underage kids are served alcohol by an adult in their home what is the adults liability if the kid gets into an accident later? Or if underage kids are drinking and the adults are not at home and have no knowledge of alcohol consumption is the liability the same if something happens later? |

Do you remember "The Gong Show?" In answer to your question, you get "gonged" if kids get served at your house. Either you knew, or should have known, or should not have left kids unsupervised. If an adult serves the kids, its clearly an opening for more charges being filed. What is the address and time of the party? Purchase of Alcohol by/for the Underaged (N.J.S.A. 33:1-81) An underage person who purchases or attempts to purchase alcohol, or lies about their age, or a person of legal age who purchases alcohol for an underaged person faces a conviction of a disorderly persons offense, which incurs a fine of not less than $500 and loss of license of r6 months to one ear. In addition, underage persons may be required to participate in a state-sponsored alcohol education program. C. Serving an Alcoholic beverage to a Minor (N.J.S.A. 2C:33-17) Anyone who purposefully or knowingly offers or serves or makes available an alcoholic beverages to a person under the legal age for consuming alcoholic beverages or entices that person to drink alcohol or makes real property owned, leased or managed by him available for the consumption of alcohol by underaged persons is committing a disorderly person offense and is subject to a fine of up to $1000 if convicted. 5. Host/Hostess Liability (N.J.S.A 2A:15-15.6) A host or hostess who provides alcoholic beverages to a visibly intoxicated guest can be held liable for injuries inflicted on a third party if that guest is involved in a motor vehicle accident. |

Debra, my statement was only a quote of some NJ laws. It is illegal to serve minors, and I wouldn't take the chance. But I do think that the laws are silly, and wish that they would be removed from the books. The choice is not really up to us anymore, or even the state. The federal government will not give highway funds to any state that has a drinking age under 21. So, if NJ wanted to change the laws, we would all end up paying a lot more in taxes. The federal government is a mess and a shame. As for a party when parents are out of town, I don't know. I suspect that if you were over 18 that you may be responsible. I don't know what the laws are like for someone who is under 18 being left at home with no supervision. What is chillax?

Radish, at the very least, your parents would be REQUIRED to hire a lawyer to defend you. Furthermore, since you are a minor, they could have legal consequences for not properly supervising you. Also, there is a possibility of heavy loss to them if an injury resulted and they were successfully sued. Jersy Boy, the gong show answer was as adult as the decision to post the question here. Ya want an adult answer, be an adult and pay the f*^%@n money to a lawyer. The form of my answer was snarky and sophmoric and immature. So what, that's the way I am. I am also the funniest guy I know and I will continue to amuse myself by being sophmoric, immature and probably snarky. Still, the meat of my gong show answer contained solid information and didn't cost him a dime.

JB, Otay. The best part of it was that I was discussing the posts with Scully at the Parkwood yesterday afternoon. I was referring to Montrose's reference to my gong post as adult and not being sure if he was sincere or snarky. I told her that I missed an opportunity to respond that, "if you wanted an adult answer..." and regreted that I hadn't. Then you gave me the perfect opportunity to resurect the argument. Damn Good! ok, I now know the law and I will choose to disobey. I think it is absolutely ridiculous that kids have such an abnormal relationship with alcohol. I rather see my kids get drunk at my home for the first time, than in some dorm room, where only God knows, what can happen to them. At home ( DK) the drinking age is 18. and we learn early on how to "deal" with alcohol. The first time I got drunk, was at my friend's house ( parents were home) and it was the new years eve, when I was in 9. grade. Not unusual where I come from. That basically means, we party and have fun in highschool ( yes they serve beer at our highschool parties) I had plenty of "before party" parties at my house before my dad would load us all up in his truck and drop us off at the highschool.... And when you hit college, you are ready to take your studies seriously. Now slaughter me!

Montrose, review the posts on this website. Almost everyone who posts on this website gets at least one silly response to their question. Sometimes they get only serious answers and sometimes they get serious information mixed with silliness (such as my post to you was). Let me apologize to you and offer to buy you a coffee, cocacola, ice cream, beer or whaever --depending on your age and taste buds. PL me if offer accepted. Shana, Your post reminds me of when I was teaching at New Providence High School during the time when the drinking age was lowered to 18. Two of my senior students were killed during that time period in two separate incidents. One lost his life on Christmas Eve. What a waste.
