Okay, I was just told that you cannot use a cell phone in New Jersey with a headset that it is now illegal. Anyone? |

From what I see on the roads, headsets just MIGHT be against the law. I rarely see them... |

I thought the law was that it had to be hands free, which would mean using a headset. Where did you see that headsets are against the law? I see TONS of people just chatting away, phones to their ears... |

Case was being funny and sarcastic. NJ definitely does have a cell phone law - you must use a hands-free phone while driving. However, I thought that this law (when I researched it yesterday) was only enforced secondarily, meaning you will not get a ticket for holding your phone unless you are stopped for some other traffic violation. An informed person recently told me that it is now a primary offense but I haven't seen this in the news or in the law myself.

I don't believe there is a law yet , I think the head set things goes into effect 7/1 . |

It's a law now. NJ Statute 39:4-97.3. New Jersey is always mentioned as having a hands-free requirement in any news article. As the statute reads now it can only be secondarily enforced. Perhaps what you read about July 1 is that they will change it to a primary violation. |

No, one of my coworkers said that is was illegal. Part of our job is driving long distances, so it is necessary to have the cell phone. Thanks for the input! |
