Is driving while under the influence and/or intoxicated a crime (of whatever degree) or an infraction (moving violation)?

Thanks. I keep getting a fail when I try to access the N.J. statute database on FIndLaw.

a very big YES!!! not only is it a moving violation, it's a stupid thing to do. you will loose your license as well. i think the first offense is six months.

here's another link to the penalities. do yourself a favor, call a call a friend, call a cab, walk, hitchhike if you have to! driving drunk is a very stupid thing to do. you could hurt or kill someone...

I asked because I was wondering why we needed a town ordinance to hold intoxicated drivers until they sober up.

sorry about my response. i meant mine as a general respose. i think the town passed ordinance to insure a person arrested for drunk driving doesn't get behind the wheel again until they sober up. more then once, after being released the person gets back in the car (still drunk).

just me,

Don't worry about it.

I had always assumed that getting tagged for DWI would put me in jail until I was arraigned and posted bail. The ordinance just got me wondering.

As an aside, does anybody know what MADD considers an "alcohol related" incident? I've always found their retoric a bit confusing.
