I would normally check via the search, but it's down tonight. I hope someone can help me out. Does anyone know how close to the property line one can put a fence? It would be in the backyard between our yard and a neighbors paved driveway. Our property is exactly to the edge of their driveway. (The fence will be be 4 ft high.) |

We put in a fence very close to our property line, but I can't remember the specifics (I think we set it back 12 inches). Give City Hall a ring and they'll put you through to the right person. You'll definitely need a fence permit. |

The correct answer is, it depends. Talk with your neighbor. If they are cool with the fence and you both agree as to the location of the property line then you can put it exactly on the line. (town permits are required) With this approach you do run the risk that if property is sold and a survey is done, and the fence is over the lines, a new owner can have the fence removed. If your neighbor does not want the fence or you can not agree as to the location of the property line, get the town permits, have the line surveyed and marked, then build the fence. If you really trust the survey to the point you are willing to go to court with the marks, you can build exactly on the line. If you want to be safe, build a couple of inches on your side and that will avoid any legal exposure should the fence lean, bow or otherwise be declared over the line.

I concur with Jgberkeley - we were told that we could build right on the line as well but ended up going with 2 inches in, just to be safe. Talk to the folks at the town hall Building Department, I found them quite helpful. |
