Does anyone know if NJ rental leases allow for a provision something like this. "the Peaceful enjoyment" of ones home. I know when we had to take our landlord to court in Massachusetts it was based on that phrase. www.freshwater-films.com

well, I don't have experience in NJ, but the phrase most often used is "quiet enjoyment", to which, I believe, every homeowner and lessee is entitled, except perhaps as may be expressly limited by deed or contract. if the contract doesn't explicitly provide for this, the law will equitably (rather than contractually) recognize the right. go to findlaw.com, choose NJ, and search under "quiet enjoyment". you may find what you need there. |

Thanks for the tip 1-2many. I appreciate it. I am still looking to find out if "quiet enjoyment" applies only to entry by landlord with notice or if it is broader still. I will keep up the search and thank others in advnace for their help. www.freshwater-films.com
