As the Brits would say, this is a sticky wicket. I just read an interesting article that discusses a married couple in New Hampshire. The husband has just undergone sex change surgery. They live in New Hampshire, which bans same sex marriages. Here's the kicker. They have a kid. Forget about your feelings about sex change operations, and your positions on same sex marriages in general. Are they still married? Should the state automatically dissolve their marriage? Is that a right that the state should have - to be able to declare a valid marriage null and void without the consent of either party, and without any fraud taking place? And if they can dissolve the marriage, what are the implications of that to the general population? I don't claim to have an answer. I think this is one of those areas where science has surpassed (or allows an end-run around) the law. |
