I have been ordered, as a condition for continued homeowner insurance, to replace two sections of concrete sidewalk in front of my house which are considered hazardous conditions.

Town regulations specify that homeowners are required to maintain sidewalks. However, the hazardous conditions exist SOLELY because of tree root growth from a Township-owned tree planted between my walk and curb.

The Township Public Works administrator claims that their responsibility is only to remove the roots, but that the cost of all sidewalk removal and replacement is my responsibility.

I don't agree with the town but I'm curious how many of you do, particularly if the town had to assume the cost of the many sections of sidewalk that are in similar condition (of course, many homeowners might not even face this situation if their insurance companies don't have to come out to inspect their houses).

The home owner is required to replace the concrete sections that are hazardous. Your contractor should call in the town to cut back the tree roots after the old cement is removed and before the new cement is laid.
