For all interested, there was a closed sesssion meeting, upon which the Board reported that it was seeking additional information from John and Ed, and that they could not provide any further information at this point in time. I note that John stated that the Village has not yet taken any official position with Beifus vis-a-vis its obligations under the contract. |

I would also ask that the question of "Conflict of Interest" be raised again with the Ethics Board in light of Eric being recused from the Beifus discussions. I am also curious if he recused himself from the "Closed Session" discussions. |

Where is Shelly and her SOAR endorsement now that Eric can't talk about Beifus? Anyone else who claimed this would not be an issue during the election want to comment? Dave??? Dan??? Bets??? Where is your judicial ruling? Dave assured us these issues were behind us and would *never* come before the board again. Let's face it, we split the vote among 5 people knowing that 2 of them would not be able to participate in these discussions. This should not be a suprise to anyone. See my forward looking statement when I asked John and Eric to step down to avoid just this. I missed the meeting last night but it appears Eric removed himself from any/all discussions on Beifus. Aplogies to everyone if I am mistaken.

Conflicts of Interest? The meeting last night was amazing and I think a separate thread should be started for that. Everyone spoke their mind. Beifus - closed session was supposed to end and they were to return to the auditorium to announce any result. Eric (after apparently being excused from closed session at a certain point, I assume because that is when Beifus was discussed) returned to the auditorium for a while and then left. I do not know if they made any public announcement after that. Is it a distance thing with Beifus to Eric's property? Jenning's husband is in the Middle School, does that fall into the distance thing? Might that development impact the Middle School? Should she be excused? Terri is part of Essex County? Isn't that road, South Orange Avenue a County road? Shouldn't she be excused from the Beifus discussions? What part of the government is she exactly? Doesn't Beifus need to go for State or County Approvals? Bill is a business owner? Isn't Beifus going to increase business in town if more residents are added? Doesn't he have something to gain? Shouldn't he be excused? Might he also care as to the type of business to be added in the retail portion of Beifus? He might want to control the size or type of store to limit any competition? During the meeting they indicated something like "at the suggestion of the Board of Ethics". Who is on the Board of Ethics, exactly who? Is the Board of Ethics state or county? Is there any conflict with Terri-Ann or Ed Matthews and the Board of Ethics??? (Did the Board of Ethics suggest Eric being excused because the issue was presented to them? Was the issue of the village administrator and a specific trustee ever presented to them? Don't you think they would have had a suggestion or two about that?????? Shouldn't all votes with that specific trustee be reviewed?) __________________________________________ A PARKING DECK ON THE TRANSIT LOT??? AND WHERE DID THAT COME FROM HOW CAN WE HANDLE THAT TRAFFIC DUMPING ON SOUTH ORANGE AVE AND CHURCH STREET? WAS A TRAFFIC STUDY DONE? WHO IS DOING THE PROPOSED CONCEPT? WHEN WAS THIS DISCUSSED AT A TRUSTEE MEETING? WHY WOULD YOU PUT A DECK IN FRONT OF THE PERFORMING ARTS CENTER AND FRONTING A RESIDENTIAL STREET? THIS SHOULD BE ON A SEPARATE THREAD.................... |

Talk, Too long of a history on the decision of the ethics board to get into in this thread. Just so you know, Eric knew when he ran (based on an opinion from his own attorney and what he put on his website) that since he owned property within 200 ft. of the Beifus site, he would be unable to participate in this discussion. |

What was the crux behind the two resolutions passed when they came out of closed session? There was no discussion or background information offered. Terri-ANN did say Beifus was under consideration by the BOT and they requested more information from the administration (blah, blah, blah) before they will answer Danny G's question. Government under glass - thanks Terri-ANN. The resolutions were authorizations to hire a deputy engineer; and secondly, an OPDE(???) contract approval???? Does anyone know why these two items were acted upon and approved after a closed session meeting? BTW: Did anyone catch Stacey's comment to Art that he looked cool in the President's chair. I guess the seat is taken, unless of course, people wake up!!!!

H. Levison: Remain vigilant, now more than ever. On May 9th, Trustees approved resolution accepting in principle amended recommendations of DMC initial board (http://www.southorange.org/news.asp?page=2). At that meeting, however, Village President requested another meeting to work out "details" of recommendation to establish a DMRC. Now that the campaigning and election are over (during which the most outspoken critics cleverly were passified), there's no telling whether this half-decade effort will survive our newly reconstituted, but similarly aligned, Board of "Trustees". |

Trustee Rosen made a good point last night that I think everyone knew, but no one had said. He said something to the extent that if Beifus had met all the requirements, there would not have been a need for a closed session... |

hmm.. and do we presume that Beifus is responsible for the site work that was done (grading, asphalt removal, new fence, etc)? Based on the comments above, the village has taken no action to take over the property or build a parking lot. So reading between the lines -- Beifus is sort of moving forward, but probably has not applied for everything he said he would, within the time he would. Anyone surprised? /p |
